BREAKING | NDPP withdraws charges against Lt-Gen Khumalo, Brig. Mokwele and six senior SAPS officers
The National Director of Public Prosecutions (NDPP) has withdrawn fraud and corruption charges against Crime Intelligence head Lieutenant General Dumisani Khumalo, Brigadier Dineo Mokwele and six other senior SAPS officers linked to the alleged irregular appointment of Mokwele.
The accused include Lt-Gen Dumisani Khumalo, Major Generals Philani Lushaba, Nosipho Precious Madondo, Josias Lekalaka and Zwelithini Gabela, as well as Brigadiers Phindile Ncube and Dineo Mokwele. They were accused of fraud and corruption in connection with Mokwele’s appointment to a senior technical support position within Crime Intelligence, with allegations that the appointment did not comply with the required recruitment processes and experience requirements.
The NDPP’s decision follows a review of representations submitted by the accused together with evidence gathered during the investigation. The charges were withdrawn before plea after it was determined that the investigation remains ongoing and the evidentiary record is not yet complete.
The withdrawal does not amount to an acquittal or a finding on the merits of the case. Any future decision to reinstate the prosecution will require the NDPP’s written approval, and the affected parties would have an opportunity to respond before any further prosecution is authorised.
The case has attracted significant public attention and was also examined during proceedings before the Madlanga Commission, where questions were raised about aspects of the evidence relied upon during the initial decision to prosecute.
